
A woman from North Carolina is suing the Los Angeles Dodgers after she was hit in the shoulder by an alcoholic BuzzBall drink at a baseball game.
Jennifer Wagner is accusing the organization of negligence.
According to the lawsuit, a BuzzBallz beverage — an alcoholic drink served in a round container approximately the size of a tennis ball — “was thrown, dropped, or otherwise propelled from an elevated seating or standing area above” where the woman was sitting during the game.
Wagner’s lawsuit says she was hit by the drink and claims she felt immediate pain, and that in addition to bruising and swelling, she also lost the normal use of her arm.
She further claims in the lawsuit that the injury she sustained at the August 6 Dodgers game significantly derailed her plans in California, including a visit to Disneyland.
“As a direct result of the incident, plaintiff’s planned four-day family vacation to Los Angeles and Disneyland was substantially disrupted and deprived of its intended enjoyment,” the lawsuit argues.
According to the filing, Wagner is the mother to two young children who were with her at the game on the day of the incident.
The children reportedly experienced “fear, shock, and emotional distress” from witnessing their mother’s injury.
In addition to the negligence claim, Wagner is also suing the Dodgers for premises liability. She claims that the organization should have predicted that serving alcohol in “containers capable of being thrown or falling” would create “a foreseeable risk of harm to spectators.”
She claims the Dodgers failed to warn her and others of the “dangerous condition” allegedly created by the Buzz Balls at the park.
She is seeking unspecified damages from the Dodgers, claiming that she has suffered physical and emotional pain, loss of enjoyment, and the burden of medical bills for past and future treatments relating to her injury.
Wagner has demanded a “trial by jury on all issues so triable.”
A Dodgers spokesperson said that the team does not comment on pending litigation.

The lawsuit isn’t the only time BuzzBallz has made headlines in Los Angeles in the last week.
In addition to the alleged incident at the baseball game, the spherical drinks are also a key element of an animal cruelty case in the city.
Cesar Gustavo Diaz, 25, has been sentenced to 45 days in jail and another year of probation after he filmed himself feeding neon green booze from a BuzzBallz container to a young Cooper’s hawk that he captured, according to the California Department of Fish and Wildlife.
“Hanging out with the homie,” one of his captions read, according to the CDFW.
In another, the hawk can been seen guzzling the liquid from the alcohol container. Diaz captioned it “Hawk loves him some buzz ball.”
