Baby faced boys aged 12 and 13 appear in court charged with raping girl, 12, who had rocks stuffed in her mouth to silence her

Two young boys accused of raping a 12-year-old girl after who had rocks stuffed in her mouth to silence her pleaded not guilty to the heinous crime.
Nelson Nunez, 13, and Jusiah Jones, 12, allegedly took the victim into a community garden in Miami, Florida on June 18 last year and attacked her.
Nunez grabbed the alleged victim as she was leaving a friend’s house and forced her onto a couch in the garden as she screamed, according to a police report obtained by WPLG.
Jones put rocks in her mouth to muffle her screams as Nunez undressed and raped her, investigators alleged. Xavier Tyson, who was 14 at the time of the attack, is alleged to have helped Jones restrain the girl.
She begged the boys to stop, but they continued the horrific assault for nearly 30 minutes, only stopping after they heard her father calling out her name, police said.
All three boys have been charged as adults, with a judge ordering that Nunez and Jones be held without bond at their court appearances last week.
Attorneys for Nunez and Jones were in court again Monday and formally entered not guilty pleas for their clients. They also argued requested jury trials and vowed that they will be ‘fighting hard to get our clients out of jail.’
Jones’s father Melvin, who attended the hearing Monday, called the allegations against his son ‘bogus’ and blamed the other two boys for the attack.
Nelson Nunez, 13, appeared in adult bond court last Friday. He is accused of raping a 12-year-old girl in a community garden in Miami last year
Twleve-year-old Jusiah Jones, who also appeared before the judge last Friday, is accused of restraining the girl and putting rocks in her mouth to muffle her screams as Nunez undressed and raped her
Xavier Tyson, now 15, is alleged to have helped Jones restrain the girl. He is also accused of sexual battery. His case has been reset and was transferred to another judge
‘A young black man that was visiting Miami — it was with the wrong two kids, a 15 and a 14-year-old. My son is 12 years old and has a father that takes care of him,’ Melvin told WPLG. ‘These allegations are bogus.’
Melvin, outside the courthouse, told WTVJ that his son is ‘not the child you guys are making him out to be.’
‘This is a 12-year-old boy we are talking about. We are going to leave him in jail and put a life charge on a young man that was with the wrong two kids?’ he questioned.
Jones’ mother echoed Melvin’s sentiment and was heard shouting outside of the court hearing: ‘It’s not true. He’s only f*****g twelve.’
Defense attorney Bijon Sebastian Parwaresch said that he and his co-counsel are looking to have Nunez, whom he represents, and Jones released from jail.
But the pair will remain in custody until at least March 18, when they will appear before the court and a judge will decide whether they will continue to be prosecuted as adults.
All three boys have been charged with rape, kidnapping and false imprisonment.
Tyson, now 15, also faces sexual battery charges. His case has been reset and was transferred to another judge.

Witnesses allege that Tyson fondled the girl’s breasts as he helped Jones hold her down, the police report said.
Nunez reportedly asked the boys ‘You think I should put it in?’ before he raped the victim. The girl could be heard yelling ‘no, no, stop, stop, it hurts’ while he assaulted her, witnesses told police.
A fourth boy who witnessed the assault but has not been charged with a crime, told police he ‘did not intervene because he was outnumbered and was afraid of getting beat up,’ the arrest report stated.
The victim’s mother, in an interview with WPLG last week, said she is seeking justice for daughter, but fears there is no punishment that will make this better.
‘I’m upset. I’m angry,’ the mother said. ‘I don’t care if they get 10, 20, 30, 40, 50 years, 100 years, guess what, I’m gonna always feel like as a mother, as a woman, I’m gonna always feel like it’s not enough.’
