Fate of Nickelodeon producer Dan Schneider’s defamation lawsuit against docuseries Quiet On Set revealed

Dan Schneider’s defamation lawsuit against Warner Bros Discovery over his depiction in a documentary series was dismissed by a California appeals court on Thursday.

Schneider sued the media giant in 2024, alleging that Quiet on Set: The Dark Side of Kids TV falsely suggested he was involved in the sexual abuse of child actors who appeared on Nickelodeon programs he presided over. 

The Second District Court of Appeal on Thursday reversed a November 2024 Los Angeles Superior Court ruling that permitted Schneider to proceed with the litigation, in a decision reviewed by the Daily Mail.

A three-judge panel said that the former Nickelodeon producer had ‘not demonstrated a likelihood of success on the merits.’

Schneider, 60, had named Warner Bros Discovery, Sony and the docuseries producers, Maxine Productions’ Mary Robertson and Emma Schwartz, in his initial suit.

Attorneys for those parties argued an anti-SLAPP motion, which is centered around guarding companies from litigation that restricts free speech.

The Daily Mail has reached out to legal representatives for Schneider and Warner Bros. Discovery, as well as Maxine Productions, for further comment on the story. 

‘The documentary clearly distinguishes between the lamentable conduct that its participants attribute to Schneider – gender discrimination, harassment, toxic workplace behavior, and inappropriate sexual innuendo – and the child sexual abuse explicitly attributed to three named individuals, two of whom are discussed at length,’ a decision from the court read.

The court noted that ‘no evidence of child sexual abuse’ was revealed in an investigation Nickelodeon conducted over Schneider. 

Quiet on Set detailed former child actor Drake Bell’s emerging as a one-time victim of acting coach Brian Peck, who in 2004 was convicted in connection with the sexual assault.

Schneider said in a YouTube clip following the release of the docuseries that he hadn’t hired Peck, and had been ‘devastated’ when Bell informed him of what had happened at the time, offering his support.

The decision stated that Schneider did not credibly prove his ‘attempt to find an alternative meaning than what is expressly stated in the documentary.’

The appeals court’s three-judge panel said that Schneider fell short in proving that filmmakers had implied his guilt by editing his image into sequences in the second installment of the series which mentioned Peck and Jason Handy, another convicted sex offender with TV industry links.

The decision from the judges said it would ‘refrain from splitting hairs to find an allegation of child sexual abuse where the only such abuse discussed is explicitly attributed to named perpetrators and the documentary expressly states that an investigation into Schneider found no evidence of abuse.’

In a statement, Robertson and Schwartz told the Daily Mail that they were ‘grateful for this ruling, protecting the constitutional rights of filmmakers and journalists to report without fear on important and difficult issues.

‘We’re proud of the continued impact of Quiet on Set, which just last week was cited in bipartisan legislation introduced into Congress to protect child actors.’

Schneider’s attorney Gerry Silver said in a statement that the producer’s camp had been looking at ‘options for further review and appeal,’ according to The Hollywood Reporter. 

The lawyer said: ‘We are pleased that the Court acknowledged that the makers of Quiet on Set presented absolutely no evidence that Dan was sexually abusive towards any of his cast members and agreed that any such allegation is provably false.’
