Driver who killed jogger in 2025 is suing victim’s family for ‘emotional injuries’

A pickup truck driver who hit and killed a jogger last year is now suing the victim’s estate, according to a new report.

Anthony Miller was fatally struck in August 2025 while on an early morning jog with his wife, Bailey Miller, in Lincoln, Nebraska, the Omaha World-Herald reports.

The driver saw Bailey jogging on the side of the road and moved to give her more space, but didn’t see Anthony, who was also running in the road, until it was too late, according to a police report reviewed by the newspaper.

Investigators reportedly said the time of day and rainy weather could have played a role in the crash, and did not issue a citation to the driver. Local outlet KOLN also reports the driver stayed at the scene and attempted life-saving measures.

That driver, identified as 25-year-old Gavin Maas, has now sued Anthony’s estate for at least $50,000 in damages, which include emotional injuries and medical costs, according to court records reviewed by KOLN.

Anthony Miller was a nurse practitioner in acute care surgery, according to the University of Nebraska Medical Center (University of Nebraska Medical Center)

In the complaint, Maas reportedly claims he suffered from PTSD after the crash and was hospitalized on multiple occasions.

The Independent was unable to identify attorneys representing Maas or Anthony Miller’s estate for comment.

Bailey told the Omaha World-Herald that she and Anthony had been married for seven years and had two young daughters together.

“The biggest honor for him was to be a dad. He loved our girls so much,” she said.

Anthony worked as a nurse practitioner in acute care surgery, according to a statement from the University of Nebraska Medical Center.

“My earliest interactions with Anthony were bedside with him as a nurse in the Surgical Intensive Care Unit. Patients adored him, speaking of his attention to detail and compassion,” Dr. Charity Evans said in the news release.

Evans added: “We were so fortunate to recruit him to ACS as an advanced practice provider. Anthony will be greatly missed. The way he cared for his patients and supported his colleagues will be a lasting example for us all for years to come.”
