Sia Alleges Ex David Bernad Was Investigated For Child Porn, Used Her Addiction Against Her In Court Docs
Sia and her estranged husband are embroiled in a bitter custody battle amid their divorce, with allegations on both sides turning increasingly contentious.

David Bernad, an oncologist who married Sia in late 2022, claimed in a court filing on Monday October 27 that the pop star struggles with substance abuse and is unfit to care for their 19-month-old son, Somersault.
In her response on Tuesday, Sia claimed that Bernad was recently under investigation for alleged possession of child pornography.
The allegations are part of ongoing divorce proceedings in California, which Sia filed in March citing “irreconcilable differences”. Bernad has since sought substantial spousal support, with a hearing scheduled for January.
Bernad is now also seeking full custody of their son, Somersault — referred to as “Summi” in court documents — claiming in Monday’s filing that Sia, who has previously been open about her struggles with drug addiction, has resumed using.
“Sia is an unfit and unreliable parent struggling with substance abuse and addiction, rendering her incapable of providing safe or stable care for Summi,” Bernad wrote in a declaration, adding that he believes Sia “is a serious and immediate danger” to their son.
“I am the only safe and reliable parent for our son. I am a doctor, young, healthy, and have no criminal history or drug or alcohol addiction issues.”
Bernad alleges that he witnessed Sia using ketamine and opioids during their marriage and claims that doctors found barbiturates and benzodiazepines in her system during a hospital visit last month.
He argues that Sia should only have supervised visits with Summi, contingent on passing a breathalyser test, and is requesting that she undergo random drug testing and that she pay $77,245 a month in child support.
In response, Sia stated in her Tuesday court filing that she has been “fully sober for over six months” and remains dedicated to her recovery. She asserts that Bernad is the one who engages in partying and recreational drug use, which she says was a key factor in her decision to divorce him.
“Dan’s attempt to weaponise my past sobriety journey — an issue long resolved and well-documented — serves no legitimate purpose and is intended only to distort the facts and undermine my credibility before this court,” writes Sia in a declaration.
“His willingness to dredge up decades-old history to serve his own financial and strategic interests demonstrates the extent to which he will go, even at the expense of his child and the child’s mother.”
Sia maintains that Summi should stay primarily in her custody, as has been the case since this March. Court documents indicate that Bernad agreed to this arrangement — including a stipulation for supervised visits — while under investigation in July for alleged child pornography discovered on his computer hard drive.
Bernad “vehemently” denies any wrongdoing, claiming that Sia “planted” the illicit material. Investigations by both the Los Angeles Police Department and the city’s Department of Child and Family Services were closed without charges, with authorities citing insufficient evidence.
Despite the custody arrangement, Sia says she is not comfortable with Bernad spending unsupervised time with Summi. She argues that he is unprepared to care for their son alone, citing his history as an absentee parent who frequently traveled abroad “at a moment’s notice” during their marriage.
