A New York court has overturned the 2020 rape conviction against Hollywood mogul Harvey Weinstein and ordered a new trial in the case. reports BBC.

The resolution states that Weinstein’s trial was not fair; prosecutors brought in as witnesses those whose testimony was not relevant to the trial.

Weinstein was convicted for his previous actions, not for the crimes he was accused of during the trial.

On Thursday, the justices ruled 4-3, saying the court “erroneously admitted evidence of alleged prior sexual conduct against individuals who were not plaintiffs in the crimes at issue.”

The decision also said the trial judge compounded the error by allowing Weinstein to be subjected to cross-examination that portrayed him in a “grossly biased” light.

One of the dissenting judges said that with its decision, “this court continues to undermine the earlier gains that victims of sexual assault have fought for.”

In 2020, Weinstein, once one of the most powerful men in Hollywood, was sentenced to 23 years in prison on sexual assault charges.

  • Weinstein, 72, will remain in prison as another sentence in California continues, where he was sentenced to 16 years in prison.
  • Allegations against Weinstein began to surface in 2017 and sparked the #MeToo movement, which exposed sexual abuse at the highest levels of the Hollywood film industry and beyond.
